GENERAL CONDITIONS

FOREWORD

Locafroid / Gastrodirect Europe SA is a direct sales service for professionals and private clients, as well as associations and various administrations.

Locafroid / Gastrodirect Europe SA is a distance selling company, selling it’s products via the Internet, by telephone, fax or by mail.

All our prices are exclusive of sales taxes.

CLIENT COMMITMENT

To order, the CLIENT must accept the general conditions by clicking on the box "I accept the terms and conditions" before validating the order. This indicates that the client accepts these terms, has read and understood all of it’s significance.

The terms may be changed at any time, and the client is invited to read them regularly. Each version of these has a specific date. Orders are governed by the terms and conditions online at the time of order.

PAYMENT TERMS

Prices may vary due to introductory prices, promotions or sales, and are subject to typographical errors. All payments must be done in advance during the order or in cash on delivery. For new accounts and for states outside the European Union, the payment must be done in advance during the order.

SHIPPING AND DELIVERY

During the delivery, the CLIENT must check, with the driver present, the compliance of the order by any means, including opening the package.

The signature of the delivery ticket will result in the final acceptance of the order and means that the material and/or product delivered is considered as compliant and the CLIENT will not be allowed to ask for any trade, refund or other compensation.

In case of wrong delivery, a credit or refund will be made to the CLIENT upon request from him by recorded delivery letter.

The CLIENT has a period of 3 days after reception of material to make his request. After this period, the product will be considered compliant and The CLIENT can no longer claim any refund or compensation.

The returns should be sent directly to Locafroid / Gastrodirect Europe SA.
This right of return will be accepted for complete products in their original packaging and are undamaged. Products returned incomplete, damaged or dirty are not returnable.

The delivery time is given by the manufacturer, distributor and transport company. Also, under no circumstances can Locafroid / Gastrodirect Europe SA be held responsible for any delay in delivery. However, this delay may not exceed fifty working days from the order date.

During this period of fifty days, the order can’t be canceled or refunded and the CLIENT will not receive interest or any other additional charges.

In case the delivery takes more than fifty days. Locafroid / Gastrodirect Europe SA will establish a credit note or refund the client after explicit request of the CLIENT by recorded delivery letter.

Locafroid / Gastrodirect Europe SA will refund the CLIENT by bank transfer, within 21 calendar days from the reception of the letter.

TRANSPORT

For deliveries to EU countries, no customs charges will be borne by the CLIENT.

For deliveries on various islands and all countries outside the European Union, an additional transport charge will be required. Customs charges will be borne by the CLIENT, and he will be informed of the price.

The CLIENT must notify Locafroid / Gastrodirect Europe SA all the difficulties of access for delivery. In case we haven’t been warned, risks and costs will be borne by the CLIENT.

 

CANCELLATION, REFUND AND RETURN

According to the Consumer Code, the CLIENT has a period of seven working days to exercise his right of withdrawal from the date of order.

He must inform Locafroid / Gastrodirect Europe SA by recorded delivery letter, without having to justify or to pay penalties, except for the shipping cost.

 

ECONOMIC REGULATION

We will be forced to suspend deliveries to those of our CLIENTs who do not respect economic regulation in vigor, in particular, a reseller selling the listed products rates at a loss.

RETENTION OF PROPERTY

Locafroid / Gastrodirect Europe SA society retains ownership of the products delivered to CLIENT until the payment is complete.

 

SELLING OUT OF THE EUROPEAN UNION

The CLIENT shall not export directly or indirectly the goods of his order outside the EU and EFTA (European Free Trade Association) without the authorization of the company Locafroid / Gastrodirect Europe SA.

Failure in this procedure will result in immediate suspension of deliveries without prejudice to the damages that the company could claim. Orders for resale outside the European Union and EFTA must specify the quantity, destination and the recipient's name.

GUARANTEE OF EQUIPMENT AND CLIENT SERVICE

Hardware Warranty

All parts of our materials and products have one year guarantee, without labor and travel expenses included.

The CLIENT makes his own responsibility the process of installation and commissioning of equipment that has been delivered or picked up by himself.

The three-phase electrical equipment is not delivered with a 380V plug.

The client may call a fitter of his choice. In this case, and whatever the problem, the CLIENT may not turn in any way against Locafroid / Gastrodirect Europe SA and may not request the cancellation of the order, or a refund, or additional charges.

The guarantee can’t be applied for all incidental, special, direct or indirect, consequential, resulting from the miss use of equipment, accident or shock.

The guarantee can’t be applied due to the fault of the CLIENT. For example, use or installation not in accordance with technical specifications of the manufacturer, detrimental use to the orderly maintenance of equipment, the use of peripherals, accessories and supplies that are not adapted.

The CLIENT may use Locafroid / Gastrodirect Europe SA’s services for assembly and connecting hardware. A quotation will be prepared and submitted to the CLIENT for acceptance, and a work schedule will be defined.

 

SPECIFICATIONS AND EQUIPMENT REPAIRS UNDER WARRANTY.

Free parts during the warranty period are provided.

Equipment under warranty to repair in our workshops:

The CLIENT will contact our technician and explain the problem he has with his equipment.

Our technical department will prepare a quotation, payable in advance, for labor and time asked to find the problem.

The technician will inform the CLIENT of the result of his research and the price of labor for the repair. The parts are under warranty and are free.

The sending and return of the material are under the responsibility of the CLIENT.

Equipment under guarantee to repair for CLIENTs in Luxembourg:

Package for travel expenses and labor within 25 km

Departure workshop: € 75.00

Package travel expenses and labor beyond 25 km.

Departure workshop: € 150.00

Equipment under guarantee to repair to the CLIENT, excluding Luxembourg:

The CLIENT will contact our technician and explain the problem that he has with his equipment.

Our technical department will prepare a quotation, payable in advance, for labor to find the problem and travel expenses to and back from the CLIENT.

The technician will inform the CLIENT the outcomes of his research and the price of labor and travel expenses for the repairs, the parts are under warranty and are free.

 

SPECIFICATIONS AND EQUIPMENT REPAIRS OUT OF WARRANTY

Equipment out of warranty repairs in our workshops:

The CLIENT will contact our technical department and explain the problem he has with his equipment.

Our service will prepare a quotation, payable in advance, for labor to find the problem.

The technician informs the CLIENT about the outcome of their research and the price of the repairs.

The CLIENT decides to accept the quotation or not.

To do this, the CLIENT must pay in advance 70% of the amount of compensation BEFORE the beginning of work and the rest at the end of the work and BEFORE the material is returned back to the client.

The sending and return of the material are under the responsibility of the CLIENT.

Equipment out of warranty repairs to the CLIENT:

The CLIENT will contact our technical department and explain the problem he has with his equipment.

Our service will prepare a quotation, payable in advance, for labor to find the problem and for the travel expenses.

The technician informs the CLIENT about the outcome of their research and the price of the repairs.

The CLIENT decides to accept the quotation or not.

To do this, he must pay in advance 70% of the amount of compensation BEFORE the beginning of work and the rest at the end of the work .

 

SECOND HAND EQUIPMENT:

The used material is sold without any guarantee and accepted by the CLIENT. He may not turn in any way against Locafroid / Gastrodirect Europe SA and pretend to any refund or exchange for any defects on the products.

CRIMINAL JURISDICTION CLAUSE

Sole authority is given to the courts of Grand Duchy of Luxembourg.
